Our client, a 46-year-old female pedestrian, was walking across a Brooklyn crosswalk when she was struck by a vehicle, causing her to fall. She was immediately transported to the hospital by ambulance, where she underwent an MRI of her knee that confirmed a medial meniscus tear.
Although her doctors recommended arthroscopic surgery to address the injury, her fear of needles prevented her from undergoing the procedure. Instead, she underwent conservative treatment, including physical therapy, for a total of six months. At the time of the accident she was employed as a home health care aide and only missed 3 days of work. However, the ongoing pain and physical limitations post-accident significantly impacted her quality of life.
Case Presentation Strategy
We focused heavily on conveying the importance of the knee joint in one’s daily life. In the closing, Gennady gave the jury a visual by walking and bouncing in the courtroom on one knee to emphasize the physical toll caused by her injury. This approach helped the jury understand the dramatic pain the client was undergoing on a daily basis.
